These Terms of Service (“Terms”) are a binding contract between you (“you” or “your”) and RCH India (“we”, “us” or “our” or “RCH India”) with respect to our website at https://rchserviceindia.com/ and its subdomains, if any (our “Site”), through which we offer our services (together with our Site, our “Services”) as an Operational and Analytical support centre for the global operations of Roc 360. The website is owned and operated by RCH India. Before you click on the “I accept” button or use our Services, read these Terms carefully. By clicking on the “I accept” button or using our Services, you are agreeing to be bound by and are becoming a party to these Terms. You represent and warrant that you have the authority to enter into these Terms on behalf of any group or entity you represent. You covenant to ensure that all users that gain access to our Services from you are bound by these Terms. 1. Scope of Services
RCH India provides Operational and Analytical support for the global operations of Roc 360. We provide accurate, quick, and seamless implementation of Roc 360’s initiatives and assist in its goal of process efficiency and a high level of support. We continuously strive to deliver operational excellence and are committed to the highest standards, while robust process guidelines ensure we are recognised and looked at as a reliable offshore team – one with considerable subject expertise..
We may alter, suspend, discontinue or subcontract our Services, in whole or in part, at any time and for any reason, without notice to the extent permitted under applicable law. Our Services may also periodically become unavailable due to maintenance or malfunction of computer equipment or for other reasons. In order to use our Services, you must have a computer, laptop or mobile device with Internet access that can access our Site.
2. Right to Use; Privacy Policy
Subject to these Terms and any other agreement between you and us, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable right to use our Services solely in the manner enabled by us and for your personal, non-commercial use. 13. Violations of provisions of Information Technology Act, 2000 and/ or Intermediaries Regulations 2021
No provision hereof shall be construed as violating any provisions of the Information Technology Act or the Rules thereunder (including without restricting the Information Technology Act, 2000)
You shall not use this website or services rendered herein in such manner as to infringe the above. We are not acting as Intermediaries in relation to any of the data covered hereby. Accordingly, you or any other user of this site shall not host, display, upload, modify, publish, transmit, store, update or share any information that:
(i) belongs to another person and to which the user does not have any right;
(ii) is defamatory, obscene, pornographic, paedophilic, invasive of another‘s privacy, including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force;
(iii) is harmful to child;

(viii) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation;
(ix) contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
(x) is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.

If you send us any Suggestions, you agree that (i) your Suggestion(s) become our property and you are not owed any compensation in exchange; (ii) none of the Suggestion(s) contain confidential or proprietary information of any third party; (iii) we may use or redistribute Suggestion(s) for any purpose and in any way; (iv) there is no obligation for us to review your Suggestion(s); and (v) we have no obligation to keep any Suggestions confidential.

16. Governing Law
These Terms, and any dispute between you and us, shall be governed by the laws of the Republic of India and submit to the exclusive jurisdiction of the courts of the applicable jurisdiction of India.
17. Dispute Resolution
In the event of any Dispute(s) or controversy arising under, or in relation to, this Terms and Conditions, such a Dispute shall be resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996.
The Dispute(s) shall be settled by a sole arbitrator, appointed by both the parties pursuant to the provisions of the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be at Chennai, India and the arbitral proceedings shall be governed by the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.
18. Miscellaneous
You may not assign or transfer your rights or obligations under these Terms, in whole or in part, to any third party without our written consent. These Terms shall bind and inure to the benefit of the parties to these Terms and their respective successors, permitted transferees and permitted assigns. We and you are independent contractors and are not partners, joint venturers, agents, employees or representatives of the other party. The headings and captions used in these Terms are used for convenience only and are not to be considered in construing or interpreting these Terms. If any part of these Terms is held to be unlawful, void or unenforceable, that part will be deemed severable and shall not affect the validity and enforceability of the remaining provisions. The failure of RCH India to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

If you are less than 18 years old, you are not authorized to use our Services or Site.
